By creating an account and using Delectable AI (“the Service”), you agree to the following terms. If you do not agree, do not create an account.1. SERVICE DESCRIPTION
Delectable AI is an AI-powered meal planning and grocery shopping assistant. The Service generates recipe suggestions, meal plans, shopping lists, and product recommendations using artificial intelligence. All content generated by the Service is for informational and convenience purposes only.
2. NOT PROFESSIONAL ADVICE
The Service does not provide medical, nutritional, or dietary advice. AI-generated recipes, nutrition estimates, ingredient lists, and meal plans may contain errors or omissions. You are solely responsible for verifying ingredients, allergens, nutritional content, and suitability for your dietary needs before preparing or consuming any food.
3. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or complete.
4. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DELECTABLE AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TEN DOLLARS ($10.00), WHICHEVER IS GREATER.
5. ASSUMPTION OF RISK
You acknowledge that meal planning, recipe preparation, and grocery shopping involve inherent risks including but not limited to food allergies, foodborne illness, and dietary incompatibilities. You assume all risk associated with your use of the Service and any recipes, meal plans, or product recommendations it provides.
6. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Delectable AI, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.
7. DATA COLLECTION AND PRIVACY
We collect and process account information, usage data, and purchase history to provide and improve the Service, including personalizing recommendations. We do not sell your personal information to third parties. Purchase history data is used solely for personalization within the Service.
8. SPONSORED CONTENT AND ADVERTISEMENTS
The Service may display sponsored content, advertisements, and promotional offers, including but not limited to sponsored product recommendations, digital coupons, and retailer promotions. By using the Service, you agree to the display of such content. Sponsored content will be identified as such where applicable. We may use your usage data, preferences, and purchase history to personalize the sponsored content and advertisements you see.
9. DEVICE CAMERA ACCESS
Certain features of the Service, such as scanning pantry items or receipts, may request access to the camera on your device. Camera access is entirely optional and requires your explicit consent through your device’s permission settings. You are never required to grant camera access. You may instead upload images from your device or choose not to use camera-based features at all, with no impact on your ability to use the core functionality of the Service.
10. MODIFICATIONS TO TERMS
We may update these Terms from time to time. If we make material changes, we will notify you through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
11. TERMINATION
We may suspend or terminate your account at any time for any reason. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.
12. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Denver, Colorado.
13. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and Delectable AI regarding the Service and supersede all prior agreements.
